USA

The CAN-SPAM (Controlling the Assault of Non-Solicited Pornography and Marketing) statute governs cold emailing in the United States. 

To comply with this law while sending cold emails, you must make sure that:

  • You provide them a clear and simple means to opt out of future communications (this doesn’t have to be a button; it may just be a sentence asking them to let you know if they don’t want to be contacted again).
  • You must respond to unsubscribe requests within ten days.
  • Along with communication, you must supply a real physical address.
  • Relevant subject lines are required.
  • You must not send an email to an address that has been harvested.

Canada

You must comply with the CASL (Canada’s Anti-Spam Legislation) in Canada.

And here is where things vary significantly from what they are in the United States.

You’ll need permission to send someone an email, either verbally or in writing. Implied consent isn’t enough. That implies you’ll need a reference from a mutual acquaintance or make a cold contact to ask for authorization to send an email.

Australia

Cold emailing in Australia is governed by Australia’s Spam Act, which states:
